The answer to this question is yes, it is illegal.  Although every time a storm threatening hail rolls around, you will find people flocking to park their vehicles in these underpasses all over the city.

What Texas Law Says About Parking Under an Overpass/Underpass

According to the Texas Transportation Code, 545.302(a)(7) prohibits stopping, standing, or parking "on a bridge or other elevated structure on a highway or in a highway tunnel. An underpass is considered a highway tunnel.

These underpasses look like the perfect spot to protect your vehicle because of all the concrete. One would think it's the perfect spot, but it isn't.

The Real Dangers of Parking Under an Underpass

Here's why you shouldn't park under an underpass during a storm.

  • You can block traffic
  • You can obstruct the view of another driver
  • Your vehicle might not be safe from flooding or flying debris
  • You might get your gas siphoned.

If you are caught doing this, the fine for violating the Texas Transportation Code 545.302 is between $50 and $200.

Your best option is to find a safe and legal place to park your car.  For some, it just means cleaning out your garage so you can use it for your car.  If you live in an apartment, you might want to pay extra for covered parking.  You can purchase items that can help keep your car safe during a hailstorm, like a hail protector.
